SYNTIXIS LABS PRIVATE LIMITED, operating under the brand name Motion Labs ("Motion Labs", "we", "us", "our") is a marketing agency headquartered in India that provides AI-assisted and traditional marketing services to businesses. We respect the privacy of our clients, their contacts, and all users of our services, and are committed to safeguarding the personal and business data you share with us.

Please read this Privacy & Data Use Policy ("Policy") to understand how we collect, use, process, store, and protect your:

  • Personal data as defined under the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023 ("Personal Data");

  • Client business data including campaign briefs, brand assets, ad creatives, analytics, and performance data ("Client Data");

  • Usage data such as timestamps, access logs, service interactions, and communication records ("Usage Data"), (collectively referred to as "Data").

Your Consent: By engaging Motion Labs for services, accessing our platform, or providing us with any Data, you acknowledge that you have read and agree to this Policy and consent to our collection, use, and disclosure of your Data as described herein. 1. Data We Collect and How We Use It

In the course of providing marketing services, we may collect, process, and handle the following on your behalf:

  • Campaign briefs, brand guidelines, and creative assets

  • Audience data, customer lists, and contact databases provided by you for campaign use

  • Ad performance metrics, analytics dashboards, and reporting data

  • Social media account access credentials (handled securely and used solely for campaign execution)

Client Data is processed strictly for the purpose of delivering agreed marketing services. We do not use Client Data for any purpose other than what is contracted, and we do not sell or share Client Data with third parties except as necessary to execute your campaigns (e.g., advertising platforms such as Meta, Google, or LinkedIn).

1.3 AI-Assisted Services

Motion Labs occasionally uses AI tools to support service delivery, including copywriting assistance, creative ideation, and data summarisation. When AI tools are used:

  • We ensure that no confidential Client Data is submitted to AI platforms without prior client consent.

  • Outputs generated with AI assistance are always reviewed and refined by our team before delivery.

  • We do not use AI tools that retain your data for training purposes without explicit disclosure.

Client Data is processed strictly for the purpose of delivering agreed marketing services. We do not use Client Data for any purpose other than what is contracted, and we do not sell or share Client Data with third parties except as necessary to execute your campaigns (e.g., advertising platforms such as Meta, Google, or LinkedIn).

1.4 Usage Data

When you interact with Motion Labs through our website or communication channels, we may collect technical information including IP addresses, browser type, device identifiers, pages visited, and time spent. This data is used for website analytics, service optimisation, and security purposes, and is processed in anonymised or aggregated form where possible.

2. Legal Basis for Processing

Under the Digital Personal Data Protection Act, 2023, we process your Data on the following grounds:

  • Performance of a contract: To deliver services you have engaged us for.

  • Legitimate interests: To manage our business operations, prevent fraud, and improve our services.

  • Consent: For marketing communications or use of optional features, where you have given explicit consent.

  • Legal obligation: To comply with applicable laws and regulations.

3. Marketing Communications

Opting out of marketing communications will not affect service-related communications necessary for the delivery of contracted work

  • Advertising platforms (e.g., Meta, Google Ads, LinkedIn) for campaign execution, pursuant to your instructions;

  • Regulatory authorities or law enforcement, where required by applicable law.

We do not sell your Personal Data or Client Data to any third party. Any third-party service providers engaged by us are contractually required to handle your Data in accordance with applicable data protection laws and this Policy.

5. Cross-Border Data Transfers

Motion Labs is headquartered in India and primarily processes Data within India. However, some third-party tools and advertising platforms we use may involve cross-border data transfers. Where such transfers occur, we take reasonable steps to ensure adequate protections are in place, including:

  • Personal Data and Client Data related to active engagements is retained for the duration of the contract and for a period of up to 3 years thereafter for legal and business purposes.

  • Financial and billing records are retained as required under Indian tax and accounting laws (typically 7 years).

  • Campaign assets and creative files may be retained for portfolio and reference purposes unless you request their deletion.

  • Access the Personal Data we hold about you;

  • Correct inaccurate or incomplete Personal Data;

  • Lodge a complaint with the Data Protection Board of India if you believe your rights have been violated.
